Edmonds Marshall McMahon, on behalf of Provident Personal Credit Limited, brought a successful private prosecution against the Defendant, Marilyn Wood, for one offence of fraud by abuse of position and one offence of fraud by false representation contrary to s.1 of the Fraud Act 2006.
There was clear evidence that the Defendant routinely committed the offence of fraud by abuse of position during her employment as a loans agent for Provident by taking out a number of loans for her own benefit, either using details of an existing customer without their knowledge or by obtaining the agreement of existing customers in a manner prohibited by Provident. Furthermore, there was evidence that the Defendant falsified and submitted fraudulent loan agreements to Provident misrepresenting the matter and failing to disclose the benefit gained by her.
On the 15th July 2016, Ms Wood appeared at the Birmingham Magistrates’ Court, where she pleaded guilty to all charges. She was sentenced to eight months’ imprisonment suspended for two years, 50 hours unpaid work, and Rehabilitation Activity Requirement for thirty days.
